Article 1 – Purpose
These general terms and conditions of sale (hereinafter the “Terms and Conditions”) govern, without restriction or reservation, all sales of optical and sunglasses (lenses and frames), as well as related products, concluded between MMC'EYEWEAR and any individual customer acting for purposes outside their trade, business, craft or profession.
As a consumer, the customer benefits from specific rights which may be called into question if the products purchased on the Website are related to the customer’s professional activity.
MMC’EYEWEAR sells products for children where purchases are made by adults. If the customer is under 18 years of age, they may only make a purchase with the prior written consent of their legal representative.
These Terms and Conditions apply to all orders placed through MMC'EYEWEAR’s website, constituting a distance contract between a trader and a consumer and, where applicable, to sales made in-store when the customer is directed there. They prevail over any other version or conflicting document, except for specific terms duly accepted in writing by MMC'EYEWEAR.
By validating an order on the Website, the customer fully and unconditionally accepts these Terms and Conditions, which are available on the Website at all times in a format that allows them to be stored and reproduced.
Acceptance of the Terms and Conditions by means of a “positive double click” takes place when the products are ordered and constitutes evidence that the customer has read these provisions. It constitutes unconditional acceptance of these Terms and Conditions. No order may be placed without such acceptance. The click is the electronic expression of “yes” or acceptance. The positive double-click process consists of a checkbox indicating the customer’s agreement, followed by a second click confirming that agreement. The click is considered “positive” where the customer is given the choice to confirm or reject acceptance of the Terms and Conditions and the order, after having been able to check the details and price and correct any errors.
The customer acknowledges having been duly informed that their agreement to the contents of these Terms and Conditions does not require a handwritten signature on this document.
The customer may save and print these Terms and Conditions using the standard features of their browser or computer.
These Terms and Conditions are available in French.
Article 2 – Pre-contractual information
Before any contract is concluded, MMC'EYEWEAR makes all required pre-contractual information available to the customer in a clear and comprehensible manner, including:
- the full identification details of MMC'EYEWEAR (company name, legal form, share capital, registered office address, registration number, telephone and email contact details, and postal address for complaints);
- the essential characteristics of the products (type of frames, type of lenses, treatments, filter category for sunglasses, etc.) and their intended use (optical or sun protection);
- the total price of each product, inclusive of all taxes, and, where applicable, any additional charges (delivery, fitting, inseparable services), together with the method for calculating such charges where the amount cannot be determined in advance;
- payment and delivery terms;
- the existence, content, conditions of implementation and limits of the statutory guarantees of conformity and against hidden defects, as well as the existence and characteristics of after-sales service;
- the conditions, time limits and procedures for exercising the right of withdrawal, and the effects of exercising that right.
The customer confirms that they have been informed of the instructions for use, care and handling of the products, including product hygiene requirements. In general, where applicable, we recommend that you carefully read the instructions for use of the purchased product before using it.
Article 3 – Account creation
To place an order on the Website, the customer must first create an account, to which a personal username and password chosen by the customer will be assigned (hereinafter the “Account”).
The Account is created online free of charge. The process requires the customer to provide their details (first name, surname, postal address and email address, telephone number and date of birth). The customer must ensure that the information provided is complete and kept up to date (by accessing the “Your Account” area of the Website).
The customer must take all necessary measures to ensure that their password remains confidential and secure. They must notify MMC’EYEWEAR, the website publisher, without delay as soon as they have reason to believe that their password is known to another person or is being, or may be, used without authorisation.
The customer is solely responsible for the accuracy and completeness of the information they have provided.
The Account is generally accessible 7 days a week, 24 hours a day, except in cases of force majeure, technical or IT issues, or telecommunications difficulties beyond MMC’EYEWEAR’s control.
Notwithstanding the preceding paragraph, MMC’EYEWEAR reserves the right to temporarily close the Website or suspend access to Accounts for maintenance purposes.
Article 4 – Orders
The customer selects the products on the Website and, where applicable, specifies the required options (colour, size, model). Before final validation, a detailed order summary (products, quantities, prices inclusive of all taxes and applicable charges) is presented to the customer, who may check its contents and correct any errors.
The order is definitively registered only after the customer has expressly validated it (by double-clicking or an equivalent mechanism), thereby confirming their commitment to pay. Once the order has been validated, MMC'EYEWEAR sends the customer, on a durable medium (including by email), a confirmation setting out the essential information of the contract: MMC'EYEWEAR’s identity, product description, price, payment, performance and delivery terms, warranty conditions, any applicable right of withdrawal, and the version of the Terms and Conditions in force.
MMC'EYEWEAR reserves the right to refuse or cancel any order for a legitimate reason, particularly in the event of a clear irregularity or bad faith. The refusal will be justified and notified to the customer.
If all or part of the products become unavailable after the order has been placed, the customer will be informed by email as soon as possible of the unavailability and the full or partial cancellation of the order.
In the event of full or partial cancellation of the order:
- The customer will be refunded the price of the unavailable product(s) as soon as possible and, at the latest, within fourteen (14) days of notification of the unavailability.
- The refund will be made using the same payment method as the one used by the customer to pay for the order.
MMC’EYEWEAR may withdraw certain products or categories of products from sale on the Website at any time, without prior notice or compensation. Orders placed by the customer before such products or categories are withdrawn will be processed by MMC’EYEWEAR.
Article 5 – Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery costs and specific services, which are specified separately before the order is validated.
MMC'EYEWEAR reserves the right to change its prices at any time for future sales. The applicable price is the price in force on the date of the order, as displayed on the Website and confirmed to the customer.
Where the contract provides for instalment payments, the pre-contractual information and order summary state the total cost over the relevant period or, where this is not possible, the method of calculation enabling the customer to assess that amount.
Any promotions granted in the form of discount vouchers are valid for one order per person only and for a specified validity period. They may not be combined with other promotional offers unless otherwise stated.
Article 6 – Payment
Payment is made online at the time of ordering, using the payment methods indicated on the Website (bank card, Klarna, PayPal, Apple Pay).
MMC'EYEWEAR does not discriminate in its payment terms on the basis of the customer’s place of residence within the national territory, the location of their payment account or their payment service provider, provided that the transaction is carried out using a payment method accepted by MMC'EYEWEAR and the authentication requirements are met.
The customer warrants that they have the necessary authorisation to use the chosen payment method. In the event of non-payment or a payment irregularity, MMC'EYEWEAR may suspend or cancel the order after informing the customer.
The Website uses an SSL encryption system designed to protect payment-related data as effectively as possible.
The invoice for the order will be sent to the email address provided by the customer and will be available in their Account if they have created one. For environmental reasons, the invoice will not be included in paper form with the delivery.
Article 7 – Delivery
Products are delivered to the address provided by the customer when placing the order, within the geographical area specified on the Website. MMC'EYEWEAR undertakes to deliver the goods within a reasonable period, which is indicated to the customer before the contract is concluded.
The risk of loss of or damage to the products passes to the customer when they physically take possession of the products. In the event of late or failed delivery, the customer must inform MMC'EYEWEAR as soon as possible using the contact details provided, so that the matter can be investigated.
No limitation of MMC'EYEWEAR’s liability may undermine its essential obligation to deliver equipment that conforms to the customer’s order.
Products are delivered in their original packaging. MMC’EYEWEAR cannot be held liable in the event of intolerance to the products concerned.
Article 8 – Warranty
MMC'EYEWEAR is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. Conformity is assessed in particular with regard to the contractual description and the product’s usual purpose.
MMC’EYEWEAR provides a 24-month warranty for its products from the date of purchase, upon presentation of the warranty and/or proof of purchase. It covers any manufacturing defect, hidden defect or other error attributable to us that affects the quality of our products. The provisions of the French Civil Code and Consumer Code relating to the statutory guarantee of conformity and the guarantee against hidden defects apply.
In the event of a lack of conformity or a hidden defect arising during the warranty period, the customer may require the product to be brought into conformity (by repair or replacement), free of charge and within a reasonable period.
Where bringing the product into conformity is impossible or disproportionate, is carried out too late or causes a major inconvenience, the customer may request a price reduction or termination of the contract in the cases provided for by law. In the latter case, the customer may return the product and obtain a refund. However, the customer may not terminate the sale if the lack of conformity is minor, which MMC'EYEWEAR must prove.
The following are not covered by our warranty:
- Scratched lenses, unless the product had this defect at the time of purchase.
- Normal wear and tear resulting from the use of your glasses.
- Breakage, unless the product had this defect at the time of purchase.
For any claim under the warranties, the customer should contact MMC'EYEWEAR using the following details:
By telephone: +33 (0)4 91 33 40 52
By email: sav@mmceyewear.com
MMC'EYEWEAR will review the case and may ask the customer to provide any relevant supporting documents (copy of prescription, quotation, invoice, description of the issue, etc.).
Article 9 – Right of withdrawal
Under Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the goods to notify their decision to withdraw, and a further 14 days from the date of the withdrawal notice to return the item.
The full refund will be made to the original payment method, including any delivery costs incurred, without undue delay and no later than 14 days from the date on which MMC’EYEWEAR is informed of the consumer’s decision to withdraw.
No refund will be made if the products have been damaged by the customer or if items are missing.
Where returned products were part of a promotional offer, including an offer of additional products, all products included in the offer must be returned in order for a refund to be made.
To exercise the right of withdrawal, the customer must duly complete the withdrawal form relating to their order within fourteen (14) calendar days from the date of receipt of the order. To do so, they must complete and submit the form by clicking “cancel my order”. MMC’EYEWEAR’s customer service team will then send the customer a return slip to include in the return parcel.
Article 10 – Personal data protection and cookies
In connection with the performance of contracts and browsing the Website, MMC'EYEWEAR may collect and process the customer’s personal data. MMC'EYEWEAR informs the customer clearly and fully of the purposes of processing, the recipients of the data, the retention period, the rights available to them (access, rectification, objection, erasure, restriction, etc.), and how those rights may be exercised.
Before storing or accessing information on the user’s device through cookies or similar technologies, MMC'EYEWEAR informs the user of the purposes of those cookies and obtains their prior consent where required by law.
Detailed information on these processing activities and the use of cookies is provided in the Website’s privacy policy and cookie policy, which are accessible from every page of the Website.
Article 11 – Customer service
Any complaint relating to an order or the performance of the contract may be sent to MMC'EYEWEAR:
· by post to its registered office address;
· by email to the address indicated on the Website;
· by telephone at the number indicated on the Website.
MMC'EYEWEAR endeavours to handle complaints within a reasonable period and to provide a reasoned response.
In accordance with the regulations on consumer mediation, MMC'EYEWEAR provides the customer with the contact details of the competent consumer mediator to which it is affiliated. These details (mediator’s name, postal address and website address) are displayed clearly and legibly:
· on MMC'EYEWEAR’s website;
· in these Terms and Conditions;
· on order forms or other contractual documents used.
If a prior complaint has not been resolved, the customer may refer the matter free of charge to the designated mediator, in accordance with the procedures set out on the mediator’s website:

Article 12 – Telephone marketing opt-out
When collecting the customer’s telephone number, MMC'EYEWEAR informs the customer of their right to register free of charge on the telephone marketing opt-out list.
Where such data is collected when a contract is concluded, information about this right is clearly and comprehensibly provided in the contractual document or on the order validation page. Registration on the opt-out list does not prevent MMC'EYEWEAR from contacting the customer for the purposes of performing the contract or providing the requested service.
Article 13 – Intellectual property and use of trademarks
The trademarks, logos, company names, trade names, documents, texts, comments, illustrations, images and, more generally, all content published on MMC'EYEWEAR’s Website are protected by intellectual property rights.
Any unauthorised reproduction, representation, distribution or use of all or part of these elements, by any means whatsoever, is strictly prohibited and may result in legal proceedings.
References to third-party brands of lenses or frames are made solely to identify the origin of the products and may not justify discriminatory restrictions on online sales or the warranties offered to customers.
Article 14 – Liability
MMC'EYEWEAR is responsible for the proper performance of its contractual obligations, unless it can prove that the failure or improper performance results from the customer’s actions, an unforeseeable and unavoidable act of a third party to the contract, or force majeure.
MMC'EYEWEAR cannot be held liable for consequences arising from use of the products contrary to their intended purpose, the instructions on the prescription, the advice given by the optician or the recommended usage instructions.
No limitation or exclusion of liability set out herein may deprive the customer of their right to receive goods that conform to the contract or reduce or remove the rights arising from statutory warranties.
When selling products on the Website, MMC’EYEWEAR provides product descriptions in the form of product pages. Every effort is made to ensure that information about the essential characteristics of the products offered for sale, warranties, payment terms and delivery terms is published before the order is placed. MMC’EYEWEAR disclaims liability for improper use of the information provided and any consequences that may arise from it, including decisions made or actions taken on the basis of that information. The customer remains solely responsible for their use of the information.
The Website or access to one or more of its services, including the online shop, may be temporarily or permanently closed without prior notice or compensation. Orders placed before the Website or online shop is closed will be processed by MMC’EYEWEAR.
Article 15 – Unfair terms
No provision of these Terms and Conditions is intended to or has the effect of creating a significant imbalance between the rights and obligations of the parties to the detriment of the customer. Any terms deemed unfair under applicable regulations shall be considered unwritten, without affecting the validity of the remaining provisions.
In the event of any difficulty in interpreting different versions of the Terms and Conditions or the Terms and Conditions and any other document, the version most favourable to the consumer shall prevail, subject to mandatory rules of law.
Article 16 – Entire agreement
These Terms and Conditions set out the entire obligations of the parties. The fact that MMC'EYEWEAR does not rely on any provision of these Terms and Conditions at a given time shall not be interpreted as a waiver of its right to rely on it at a later date.
If one or more provisions of these Terms and Conditions are held to be invalid, unlawful or unenforceable by a final court decision or as a result of a change in regulations, the remaining provisions shall remain in full force and effect.
Article 17 – Applicable law and dispute resolution
These Terms and Conditions and the contracts concluded under them are governed by French law.
In the event of a dispute, the customer is invited to contact MMC'EYEWEAR first in order to seek an amicable solution. If no amicable agreement is reached and after referral to the competent consumer mediator, the dispute may be brought before the territorially competent French courts in accordance with the ordinary rules of law protecting consumers.
Article 18 – Amendments to the Terms and Conditions
MMC'EYEWEAR reserves the right to amend these Terms and Conditions at any time to reflect changes in regulations or its range of services. The Terms and Conditions applicable are those in force on the date of the order. They remain available on the Website on a durable medium that allows them to be reproduced.
